Welcome to HealthVas ("Company", "we", "our", "us"). These Terms of Service ("Terms", "Terms of Use") govern your use of our website and mobile application (collectively, the "Service") operated by Healthpetron Private Limited.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

Definitions

"Service" refers to the HealthVas website, mobile application, and related services provided by Healthpetron Private Limited.

"User", "You", "Your" refers to the individual accessing or using the Service.

"Lab" or "Service Provider" refers to third-party diagnostic laboratories and healthcare providers partnered with HealthVas.

"Booking" refers to the order placed by the User for diagnostic tests or packages through the Service.

Nature of Services

HealthVas is a technology platform that aggregates diagnostic services. We act as an intermediary between Users and NABL-certified third-party Labs.

We are NOT a diagnostic laboratory. We do not conduct tests or generate medical reports ourselves.

We facilitate:

Listing of tests and health packages from various Labs.
Booking of appointments for home sample collection or lab visits.
Collection of payments on behalf of Labs.
Delivery of test reports generated by the Labs.

By using our Service, you represent and warrant that:

You are at least 18 years old or visiting under the supervision of a parent or guardian.
You have the legal capacity to enter into a binding contract.
All registration information you submit is truthful and accurate.

Account Registration

To access certain features of the Service, you may be required to register for an account. You agree to:

Provide accurate, current, and complete information during the registration process.
Maintain the security of your password and identification.
Maintain and promptly update your registration data.
Accept all risks of unauthorized access to the registration data and any other information you provide to us.

Bookings and Payments

Pricing: Prices for tests and packages are displayed on the Service. While we strive for accuracy, errors may occur. Prices are subject to change without notice.
Payment: You agree to pay all charges at the prices then in effect for your purchases using one of our accepted payment methods.
Order Confirmation: Your booking is confirmed only upon receipt of payment or confirmation of "Pay on Collection".
Cancellations: You may cancel your booking as per our Cancellation & Refund Policy. Late cancellations may attract a fee.

Home Sample Collection

Service Availability: Home collection services are subject to the availability of phlebotomists in your area.
Procedure: A phlebotomist will visit your provided address at the scheduled slot. You agree to provide a safe and hygienic environment for the sample collection.
Rights to Refuse: The phlebotomist or HealthVas reserves the right to refuse service if the environment is deemed unsafe or if the patient is uncooperative or abusive.

Test Reports

Turnaround Time (TAT): The estimated time for report delivery is provided by the Lab. This is an estimate and not a guarantee. Delays may occur due to technical or logistical reasons.
Accuracy: Reports are generated by the partner Lab. HealthVas is not responsible for the medical accuracy, errors, or interpretation of the reports.
Delivery: Reports will be delivered digitally via the App, Email, or WhatsApp. Physical copies are generally not provided unless specified.

User Responsibilities

Medical Preparation: You are responsible for following any pre-test preparations (e.g., fasting) as instructed. Failure to do so may result in inaccurate results or cancellation of the test.
Accurate Information: You must provide accurate patient details (Name, Age, Gender, Medical History) to ensure correct reporting.
Consultation: Our reports are for information purposes. You should always consult a qualified doctor for interpretation and medical advice.

To the maximum extent permitted by law, Healthpetron Private Limited shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages.
Any medical negligence, misdiagnosis, or service deficiency by the third-party Lab.
Any injury or harm resulting from the sample collection process, except where directly caused by the gross negligence of our personnel.
Delays in report generation or delivery.

Our total liability for any claim arising out of or relating to these Terms or our Services shall not exceed the amount paid by you for the specific Service giving rise to the claim.

Indemnification

You agree to defend, indemnify, and hold harmless Healthpetron Private Limited, its licensees, and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Healthpetron Private Limited and its licensors. The Service is protected by copyright, trademark, and other laws of both India and foreign countries.

Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts located in Gurugram, Haryana.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
